In court papers, the state of Ohio has called Nanci Jo Frazer’s Focus Up Ministries a “front” for the Profitable Sunrise HYIP scheme and alleges that Focus Up changed its name to Defining Vision Ministries Inc.  in June 2013 — two months after the SEC brought the Profitable Sunrise fraud action in federal court in Atlanta.

Records suggest Nanci Jo Frazer also is known as Nancy Jo Frazer. The Ohio court documents list the “Nancy” spelling. Other documents list the “Nanci” spelling.

A judge in Williams County, Ohio, has ordered Frazer, Focus Up and other entities associated with Frazer to “[i]mmediately cease all activities on behalf of any charitable organization/trust in the state of Ohio,” to preserve assets and to return assets that already may have been dissipated.

The judge also ordered Frazer and others to cease selling unregistered securities. Meanwhile, the judge ordered three Ohio banks to take eight accounts linked to Frazer and others into “actual and/or constructive possession.” Frazer resides in Bryan, Ohio.

Ohio Attorney General Mike DeWine and the Ohio Department of Commerce said today that the state has brought civil fraud charges against Frazer, Focus Up, Defining Vision and others. Documents say the state believes Frazer was a pitchwoman for the AdSurfDaily Ponzi scheme and other “programs,” including Zeek Rewards and Profit Clicking.

“This case involves a worldwide pyramid scheme that defrauded Ohioans and others out of millions of dollars,” DeWine said. “These individuals brought the scheme to Ohio by promising outrageous returns and telling investors that their donations and investments would help charities. We will continue to work closely with the Department of Commerce to hold the defendants accountable for their actions.”

Also charged were David Frazer, Frazer’s husband, and Albert Rosebrock, a member of Frazer’s NJF Global Group.  Rosebrock also was alleged by Ohio to be an AdSurfDaily and Zeek affiliate.

Purported Profitable Sunrise operator “Roman Novak” is called “John Doe” in Ohio’s complaint, leading to continuing questions about whether “Novak” actually exists. In April, the SEC said that Profitable Sunrise pitchmen may not even have known with whom they were doing business. Profitable Sunrise purported to pay up to 2.7 percent interest a day. The SEC said it was using a “mail drop” in England and offshore bank accounts potentially to scam tens of millions of dollars.

Frazer’s group may have driven $30 million to the scam, according to court files.

The Cleveland Plain Dealer is reporting that Rosebrock is blaming the SEC for the collapse of Profitable Sunrise.

From a statement by Ohio prosecutors (italics added):

Profitable Sunrise is an international pyramid scheme recently shut down by federal and international authorities. Profitable Sunrise claimed to be a Christian company that would use investment proceeds to help charities and provide investors with large returns. According to the state’s complaint, the Frazers, of Bryan, and Rosebrock, of Sherwood, used Focus Up Ministries’ status as a charity to solicit donations and investments into Profitable Sunrise. They also claimed that invested funds would compound at 1.6 to 2.7 percent daily, growing at annual rates of 5,000 to more than 75,000 percent.
 
The complaint also alleges that the defendants used funds donated to Focus Up Ministries for personal expenses and other unlawful purposes. These included financing for personal business ventures, the purchase of a big screen television, no-interest personal loans, and compensation for agents who solicited on behalf of the Profitable Sunrise pyramid scheme. The complaint contains counts of misrepresentation, deceptive acts and practices, conversion, falsification, securities fraud, and unlicensed sale of securities, among other violations.

The SEC has described Zeek Rewards as a $600 million Ponzi- and pyramid fraud. AdSurfDaily was a $119 million Ponzi scheme, according to the U.S. Secret Service. Meanwhile, ProfitClicking is a “program” linked to Frederick Mann, the purported operator of JSSTripler/JustBeenPaid, which has come under regulatory scrutiny in Italy and the Philippines.

If Frazer was a pitchwoman for ASD, Zeek and ProfitClicking/JSS/JBP, it would mean she was pushing Profitable Sunrise after various well-publicized regulatory or law-enforcement actions against those “programs,” which purported to pay interest of between 1 percent and 2 percent a day. (ASD = 1 percent/day; Zeek = 1.5 percent/day; ProfitClicking/JSS/JBP = 2 percent/day.)

Beyond that, it would mean Frazer pushed the purported 2.7 percent a day Profitable Sunrise “Long Haul” plan, even though agencies filed various actions against the “lower-paying” programs with which she allegedly was involved previously.

Some HYIP promoters move from one fraud scheme to another, while engaging in willful blindness. ASD is known to have had ties to the “sovereign citizens” movement. Mann, of ProfitClicking/JSS/JBP, once used a website to drive traffic to videos featuring Francis Schaeffer Cox, a purported “sovereign citizen” and “militia” man implicated in a murder plot against public officials in Alaska.

    I’m hurt that he failed to give Jim and I the credit we deserve according to Nanci Jo.

    Now what was truly funny is when she claimed that Jim Paris was really Roman Novak, and he and I conspired to take Profitable Sunrise down. Of course this is after she claimed Jim and I were the cause of Profitable Sunrise being forced to shut down and the authorities issued all their warnings and cease and desist orders. Hard to keep all those stories straight.

  7. Back in the glory days of Profitable Sunrise, Nanci Jo was telling everyone how important Roman Novak was to her, and how he had changed her life. What a Godly man he was, and what great things he was doing with his program. She even said she had met him face-to-face, and had seen all the documents that proved his business was legitimate.

    Now it seems that Nanci Jo has memory loss for this is what she said in the article posted above, and I quote:

    So now, it looks like her husband has been fired, she is going to owe potentially millions in restitution, fines etc… and will likely face criminal charges.

    Highly doubt it, John. ProSun was just a generic HYIP script whose owner hit the lottery when it gained all those promoters and investors. All that he did was change the names of the people in the description of the site. There was actually another HYIP that listed Roman Novak as the operator, but it had failed months before. He apparently only contacted people in the “program” from a cell phone and never the same one twice. It’s really entirely due to the efforts of the promoters that this got as many people as it did. It really shouldn’t have.

    As for Nanci Jo, I hope the prosecutors are able to use how she and her fellow pitchmen referred to Lynn Edgington as Satan and claimed that he wanted to take down ProSun so that people couldn’t be rich. Completely ignoring the fact that he’s the owner of a 501(c) designed to protect people from fraud that existed way before ProSun. But then they claimed he made Eagle just for this. Or that he’s running a scheme to get people to gift money to his non profit charity. And that nobody inside ProSun was unhappy with it and that it was nobody’s business.

    It’s almost poetic justice that she and other promoters are the ones left to deal with legal trouble when “Roman Novak” split. It’s like they went brain dead as they promoted a criminal enterprise for a commission (a fairly sizable one but not nearly as much as what Novak was making) using their real names without any kind of exit strategy. But if they were still blaming Lynn and James Paris for this, they’d claim that they were behind all those states putting out alerts against ProSun and were the ones who made Roman have to “retire” to the beaches somewhere with a woman he just met. Instead of just giving back all the money he took.

    Because God told Roman to keep it. It’s amazing what they expected people to believe. It’s a strange mixture of being funny and absolutely disgusting.

    Actually, eight accounts remain frozen. The judge did free up $20,000 for Nancy Jo and David to pay legal bills and $8,000 for Albert Rosebrock to pay legal bills. The case is still open and Frazer et al. may have exposure in other states and jurisdictions.

    It’s easy enough for me to imagine that the FBI could benefit from interviewing Nanci Jo Frazer and that polite agents would thank her. It’s pretty clear that Profitable Sunrise operated as a racketeering enterprise and that at least some of its promoters were in the “sovereign citizens” movement or on the fringes of it.

    I’m thinking that the FBI would see that as a pretty wicked combination — i.e., an international criminal enterprise linked to people who express a view that no laws apply to them and sometimes engage in “paper terrorism” against judges, prosecutors, agents and litigation opponents.

    And since the identity of purported Profitable Sunrise operator “Roman Novak” isn’t known — and since religion was part of this mix — it could mean that the Christian community was tapped as a funding source by international racketeers (or worse) to make trouble against the United States and to cause economic pain and/or disruption for Americans.

    It also apparently made her vulnerable to the person she says she assisted in AdSurfDaily’s 1-percent-a-day “program” and to the 1.5-percent-a-day “program” of Zeek Rewards — and perhaps also to the 2-percent-a-day “program” of JSSTripler/JustBeenPaid/ProfitClicking.

    ASD was a $119 million Ponzi scheme pushed by a man who described himself as a Christian “money magnet” and “defended” by a “sovereign citizen” (Kenneth Wayne Leaming) now in prison for filing bogus liens against public officials, harboring federal fugitives (from a separate scam) and possessing firearms as a convicted felon. Compared to ASD’s Andy Bowdoin, who’s doing 78 months in federal prison, Bernard Madoff was a piker in terms of suggesting how much money investors would earn on an annualized-percentage basis.

    One might think that the ASD case might have given Nancy Jo Frazer a strong clue something was seriously and criminally amiss at Profitable Sunrise.

    And one also might think that the SEC’s Zeek action alleging a $600 million Ponzi- and pyramid scheme with the purveyor accused of fudging the math in the same fashion as ASD’s Bowdoin fudged it might have given Nancy Jo Frazer a strong clue.

    Moreover, one might think that the noxious demonizing of the U.S. government by JSS/JBP/ProfitClicking’s Frederick Mann might have given Nancy Jo Frazer a strong clue that something was seriously and criminally amiss at Profitable Sunrise. Frederick Mann, a former ASD promoter, used one of his websites to drive traffic to YouTube videos of Francis Schaeffer Cox, a “sovereign citizen” and “militia” man implicated in a murder plot against public officials in Alaska and now sentenced to a lengthy jail term.

    With this fact set, one had to overlook a publicly-accessible library of information that practically screamed “Don’t join Profitable Sunrise!”

    And when one considers Nancy Jo Frazer suggested that the U.S. government was conspiring against the HYIP world by waiting to act until a program “hit about $50 million per month” and was interested in carving off “a percentage of the take,” well, it’s hard to describe that level of detachment.

    “When I saw Profitable Sunrise was offshore, that was the very first thing that attracted me to the project,” she said, laughing.

    I’d encourage you to apply the “don’t touch a hot stove” moment from your childhood here, Heather. ASD was a hot stove, but the warning went unheeded. Zeek was a hot stove, but the warning went unheeded. JSS/JBP/ProfitClicking was a hot stove, but THAT warning went unheeded. All the warnings from the SEC and FINRA went unheeded.

    Profitable Sunrise was an exceptionally hot stove in this context, and even THAT warning went unheeded.

    In fact, the narrative demonizing the government and positioning Profitable Sunrise as a attractive opportunity because of its “offshore” nature (in the aftermath of the onshore ASD and Zeek actions and the apparent success Frederick Mann enjoyed while hiding from U.S. regulators and comparing the United States to the Mafia and murderers) demonstrates to me that Nancy Jo Frazer put the pursuit of profits over everything else.

    Oh, brother . . . The HYIP world is what is creating the unhappiness, not the Bloggers who write about it. Demonizing the media ain’t gonna help. Heather. These schemes are plundering investors of billions of dollars in the age of terrorism and cross-border organized crime over the Internet.
