  • No Immediate Comment From Zeek Receiver On Third-Party Lawsuit That References Zeek Pitchman T. LeMont Silver And 100 ‘Does’; MLMers Sue Each Other — And Receiver’s Law Firm Represents Plaintiffs In One Of The Cases

    gofunplacesUPDATED 8:48 A.M. EDT (MARCH 24, U.S.A.) Oz at BehindMLM broke the news that eAdGear Inc. and GoFunPlaces Inc. have sued Randal Williams and JubiMax LLC (and others) — and that Williams earlier had sued eAdGear and GoFunPlaces (and others).

    You’ll see a reference to Randal Williams in this August 2011 PP Blog story about a scheme known as “Fast Profits Daily,” a cycler matrix pitched in part from the Ponzi boards. Fast Profits Daily had promoter ties to Jeff Long’s AutoXTen cycler matrix. Two of the infamous claims surrounding AutoXTen was that $10 could fetch $200,000 very quickly and that the “program” was suited for churches.

    Long was fresh from the NarcThatCar and DataNetworkAffiliates MLM scams when AutoXTen was gaining a head of steam. (Memory Lane: DNA misspelled the name of its own departing CEO while at once claiming domain registration in the Cayman Islands, a tax haven.)

    There is plenty of offshore intrigue in the developing stories about eAdGear/GoFunPlaces/Williams/JubiMax matters, too.

    As for Fast Profits Daily? Well, it claimed that “ALL Purchases are FINAL and NO REFUNDS or CHARGEBACKS are allowed. Any attempts to acquire a refund or chargeback constitute theft and fraud, and are grounds for legal prosecution.”

    Pardon us while we vomit as we remember recent MLM history and the interconnectivity of schemes and report on some new history in the making . . .

    The stories by Behind MLM on the allegations flying between parties in the matters pertaining to eAdGear, GoFunPlaces, Williams and JubiMax aren’t apt to make the trade feel any better about itself, perhaps particularly since at least 30 regulatory agencies have issued cease-and-desist orders or Investor Alerts on the Profitable Sunrise scheme.

    MLMers rushed to Profitable Sunrise, too. This they did both before and after after the August 2012 Ponzi complaint by the SEC against the Zeek Rewards “program.” And they did it after the attorney general of North Carolina issued a warning on “reload scams.”

    The PP Blog yesterday sought comment from the Zeek Rewards receivership on the actions involving eAdGear, GoFunPlaces, Williams and JubiMax.

    That’s because eAdGear once filed a lawsuit against ZeekRewards.com, amid some strange circumstances.

    And it’s also because McGuireWoods, the law firm for the Zeek receivership, also is representing eAdGear and GoFunPlaces in their lawsuit against Williams and JubiMax and 100 “Does.” (It is not the Charlotte-based Zeek receivership suing Williams, JubiMax and the Does, it is Los Angeles-based attorneys from the same national law firm hired by the Zeek receiver.)

    Whether Kenneth D. Bell, the receiver in the Zeek case, was aware of the McGuireWoods-managed lawsuits against Williams and JubiMax is unclear. The receivership did not immediately reply to emails seeking comment.

    Also unclear is whether the lawsuits could pose any conflict for the receivership.

    In the eAdGear/GoFunPlaces lawsuit against Williams/JubiMax, the firms raise the name of T. LeMont Silver in the body of the complaint.

    Silver is a former Zeek pitchman who participated in a conference call with Zeek figure Robert Craddock to condemn the SEC and the receiver for their actions in the Zeek Ponzi case.

    Silver recently has been musing about “asset protection things” — this after the Zeek receiver has publicly stated that he has “obtained information indicating that large sums of Receivership Assets may have been transferred by net winners to other entities in order to hide or shelter those assets.

    Meanwhile, former Zeek pitchman Gregory Baker also participated in conference calls with Craddock. After Zeek, Baker became a pitchman for GoFunPlaces.

Now, A Penny-Auction Site Married To MLM-Like Scheme Purportedly Tied To Effort To Save Children From Hunger Or Becoming ‘Sex Slave[s]’; Build Up To ‘Founding Member’ Sales Pitch Drops Names Of White House, Chelsea Clinton, Historian And Presidential Adviser Doug Wead, Unidentified Presidential Candidate And NBC News Anchor Lester Holt

    EDITOR’S NOTE: It is true that far too many of the world’s children live in poverty. It also is true that children may become the objects of criminals who engage in human trafficking and that children are exploited in the sex trades. It is equally true that legitimate charities exist to combat these horrific situations and that one MLM “program” after another has tried in recent times to tug at the human heart and “marry” their “programs” to a purported cause. If you desire to improve the human condition for the masses of children, it likely is best to donate directly to a legitimate charitable organization, rather than joining a get-rich-quick scheme that says it is doing good work behind the scenes.

    UPDATED 6:57 P.M. EDT (U.S.A.) WARNING: The following development in MLM La-La Land may be harmful to your gag reflex.

    Zeek Rewards, the U.S.-based MLM “program” that wraps itself in the American flag, collects sums of up to $10,000 from participants, plants the seed affiliates can earn a return of between 1 percent and 2 percent a day while insisting it is offering neither securities nor an investment program, has a payout scheme similar to the AdSurfDaily Ponzi scheme and securities swindle, is married to a penny-auction site known as Zeekler that has told successful bidders for sums of U.S. cash that they can receive their money via offshore payment processors and preemptively denies it is a pyramid scheme, has some emerging, U.S.-based competition.

    The name of the “program” is “BidsThatGive” — and it unabashedly tugs at heartstrings while at once asking prospects to imagine themselves behind the wheel of a grand automobile and feeling good because they also could become a “Contributor” for $10 a month, a “Guardian” for $50 a month, a “Benefactor” for $100 a month” or a Global Ambassador” for $250 a month and pile up mountains of cash while they’re displaying a social conscience.

    Two of the core aims of the “program,” according to a nine-minute video promo running on YouTube, are to help impoverished children and children who’d been exploited and became “sex slave[s].” The prelaunch of BidsThatGive appears to have been timed to coincide with the Independence Day holiday period in the United States.

    One of the assertions in a the YouTube video is that the “rewards” the company provides include “an orphanage and a school, church or hospital built in your name.” All of this apparently is possible because BidsThatGive has a “global business model” and employes a “concept” known as “PPSC,” which stands for Private Profit Sharing Company.

    But before we get to the uber bizarre, let’s address the run-of-the-mill bizarre in this latest entry in MLM La-La Land.

    BidsThatGive is a little bit Andy Bowdoin. Indeed, the emerging penny-auction company with an MLM-style compensation plan, claims it’s not an MLM program and tells prospects they’re “probably not going to sleep at night” once they understand the profit potential. Bowdoin, the infamous AdSurfDaily Ponzi schemer, told prospects that ASD was not a “network marketing company” and used largely the same line about all the sleepless nights excited prospects would experience.

    Meanwhile, BidsThatGive is a little bit like AdViewGlobal (AVG), a collapsed 1-percent-a-day Ponzi autosurf federal prosecutors said in April 2012 had ASD ties. AVG once claimed that one of its desires was to save the rainforest through charitable contributions. BidsThatGive also resembles ClubAsteria, which offered outsize weekly returns ranging from 3 percent to 8 percent and told prospects that its charitable arm would provide relief to victims of the devastating earthquake in Japan last year. ClubAsteria also purported to provide aid to children and claimed its mission was to elevate the word’s poor out of poverty.

    Last year, the American Red Cross sent Club Asteria a letter demanding it stop using the Red Cross name in promos.

    And BidsThatGive also resembles DataNetworkAffiliates (DNA), which tied itself to the U.S. AMBER Alert system for rescuing abducted children and said its “token system” could help prevent child poverty.

    “Help DNA Feed A Million. OVER 1000 AN HOUR DIE. The DNA Token System Can Prevent This!” the company exclaimed.

    Among other things, DNA used a YouTube video to trade on the name of Adam Walsh, the 6-year-old who was abducted and murdered in Florida in 1981. Adam’s father, John Walsh, became a prolific advocate for children and later became the host of the “America’s Most Wanted” television series.

    DNA, which was associated with longtime MLM huckster Phil Piccolo, appears not to have helped a single abducted child or a single child living in poverty. Affiliates, though, tried to plant the seed that the DNA “program” was backed by Oprah Winfrey and Donald Trump. When DNA’s CEO resigned suddenly in 2010, the company waited nearly a week to announce the departure — and then misspelled the former CEO’s name.

    BidsThatGive Operator

    Randy Jeffers, an MLM aficionado, is the purported operator of BidsThatGive, according to promo videos on YouTube. Jeffers also presides over a nonprofit entity known as “Liberty Kidz,” which says its “[v]ision is to empower a child to be all that he or she is created to be, by providing homes, help and hope for discouraged, displaced and distressed children of the world.”

    A similarly named Jeffers’ entity known as Liberty International LLC filed for bankruptcy in August 2010, listing about $1.94 million in debt and $641 in assets, according to federal records. The assets consisted of the balance of a business checking account.

    What follows are comments from Jeffers in the nine-minute sales pitch for BidsThatGive on YouTube (italics added):

    You know, there are so many terrible things that happen to children all over the world. Right now a little boy is dying of hunger, a little girl just got sold by her mother and is being forced into life as a sex slave.

    Right now, children are being physically abused, and then there’s so many children that are just left by themselves and there’s no one there to love or care for them. I don’t know why bad things happen to innocent little children, but they do. But here’s what I do know: All of us can do something about it.

    You see, that’s our No. 1 purpose. This company was founded to be a true partnership between those children, the children’s charities that it supports and its affiliates who make it all happen.

    A ‘Founding Member’

    One of the founding members of BidsThatGive is Glen Woodfin, according to 6:56 promo video dated July 2 and running on YouTube.

    Woodfin describes himself in the video as an American who once moved to Brazil to be with his “multimillionaire” fiance who had 90 employees. Enjoying the “good life” on the beach while sitting around drinking “coconut milk” was fun for a while, but ultimately led to a desire to become more productive and to develop an online skill set. Woodfin ultimately discovered he had a talent for search engine optimization and that clients were interested in those services.

    His SEO skills ultimately became so good that “I was hired by somebody running for President . . .,” according to Woodfin, who narrates the video. He did not identify the candidate.

    Woodfin, however, goes to to explain that he was fortunate to know author and White House adviser Doug Wead, who wrote “All The President’s Children,” a New York Times Bestseller. (Wead’s Wikipedia entry says he advised GOP Presidents George H.W. Bush and George W. Bush.)

    Apparently in the market for SEO advice, Wead turned to Woodfin, according to the video.

    “He said, ‘Glen, we’ve got one of the Presidential children about to get married in three weeks, and we don’t have a website up. Can we get in there and get to the top of the search engines with it?’” Woodfin recalled.

    That Presidential child, according to Woodfin, was Chelsea Clinton, daughter of former President Bill Clinton and U.S. Secretary of State Hillary Clinton.

    Over the weekend Chelsea Clinton got married, Woodfin said, his SEO techniques on Wead’s behalf put a site known as ChelseaClintonWeddingWatch.com at the top of the rankings. (Chelsea Clinton was married on July 31, 2010.)

    When NBC News anchor Lester Holt was interviewing Wead, Woodfin said, Holt mentioned the website Woodfin had put at the top of the rankings, apparently attributing the feat to Wead.

    Neither BidsThatGive nor Jeffers is mentioned in the first three minutes of the Woodfin video. But at roughly the 3:03 mark, Woodfin announces, “I’m going in business with a gentleman named Randy Jeffers. Randy Jeffers started the No. 1, fastest-growing MLM of all time, called Destiny. They put in 1 million distributors in 18 months.”

    Woodfin goes on to say that Jeffers recently called him and offered him a “founder’s membership” in BidsThatGive.

    “While he’s talking, the hair start[s] standing up on my arm, and I got thrilled,”  Woodfin recalled. “As a matter of fact, every time I get off the phone with him now, I’m just, ‘Thank you for putting this together.’ It’s based on penny auctions . . .”

    It’s not known whether Woodfin contacted the White House, Wead, Clinton and Holt as a courtesy to let them know he’d be using their names in a YouTube pitch for Jeffers’ BidsThatGive. What is known is that namedropping is common in the MLM sphere — often without the knowledge of those whose names are dropped.

    Although the Woodfin pitch did not imply that any of the celebrities or institutions mentioned in the pitch endorsed BidsThatGive, the implication was clear that BidsThatGive prospects who joined under Woodfin would gain access to an SEO expert who’d worked for a Presidential candidate and knew a Presidential adviser.

    Neither the Jeffers’ video nor the Woodfin video referenced the Liberty International LLC 23-month-old bankruptcy filing. Nor did either video address any of the potential problems BidsThatGive could encounter from regulators.

    Like the Zeek Rewards’ business model, the BidsThatGive model resembles that of ASD. In 2008, the U.S. Secret Service seized more than $80 million from ASD-related bank accounts, including $65.8 million in the personal accounts of Andy Bowdoin.

    Court records showed that ASD was trading on the name of then-President George W. Bush. Analysts saw it as a transparent bid to sanitize the “opportunity” by trying to link it to the White House.

    Major politicians from both sides of the aisle have seen their names used in promos for “opportunities” that proved to be Ponzi schemes.

    Former President Clinton’s name and image were used by the Mantria Corp. Ponzi scheme. Clinton is a Democrat.

     

  • ‘TEXT CASH NETWORK’: RED FLAGS GALORE: New ‘Opportunity’ Linked To Ponzi Boards And To Phil Piccolo-Associated ‘Firms’: Hype, Vapid Claims, Alexa Charts, Launch Countdown Timer, Brand Leeching — And Possible Ties To Long-Running SEC Case

    Until four days ago, the OWOW website associated with Florida-based huckster Phil Piccolo shared this message about Text Cash Network (TCN) with visitors. Joe Reid, a Piccolo associate, is leading conference call-cheerleading for TCN. Reid previously led cheers for Data Network Affiliates, another business linked to Piccolo.

    EDITOR’S NOTE: A “program” known as Text Cash Network (TCN) that purports to share “advertising” revenue from text messages is spreading virally on the Internet. This column includes information prospective TCN members might want to consider before joining and asking others to join. There are red flags galore. Last week, the PP Blog compiled some research and sought comment from the SEC about the emerging program because the name of Brett Hudson, billed in TCN promos as the firm’s “president,” appears in a 2005 “press release” that quotes Hudson and Richard A. Altomare. The SEC acknowledged receipt of the Blog’s inquiries, but did not comment.

    Altomare, of Boca Raton, Fla., was sued in this 2004 SEC action amid allegations of penny-stock fraud coupled with bogus press releases. The case, which involved an Altomare company known as Universal Express Inc., evolved to become an exceptionally ugly one. Altomare ultimately was found in contempt of court for flouting judicial orders and ordered jailed in New York. The court-appointed receiver in the case allegedly received threatening emails from individuals unhappy about the SEC’s action and follow-up events.

    Here are quotes from two of the threatening emails, which allegedly were sent by investors. The quotes appear in an exhibit filed in federal court in the Southern District of New York:

    1.) ” . . . you are going to be hit with a shit load of lawsuits, and if justice doesn’t prevail the good old American way then I will make it my personal duty to enforce the justice and I along with others will come and beat your ass to a bloody pulp, along with Judge (jackass) Lynch . . .”

    2.) . . . you fu[!!!!!] slut . . . don’t get smart . . . you have no idea what could happen to you . . .”

    Hudson, who has not been accused of wrongdoing, was not named a defendant in the SEC case. TCN promoters have identified him as president of Universal Cash Express, a company with a name similar to Altomare’s Universal Express Inc. entity. The 2005 “press release” that quotes Hudson and Altomare also identifies Hudson as the president of Universal Cash Express. Altomare’s title was not listed in the 2005 release, but the document was issued under the name of Altomare’s Universal Express entity ensnared in the SEC probe.

    Until a few days ago, TCN was prominently featured on the website of OWOW (OneWorld, One Website), a site linked to Data Network Affiliates (DNA) and serial MLM scammer Phil Piccolo. Piccolo is known online as the “one-man Internet crime wave.”

    Like Altomare’s Universal Express Inc. entity, DNA was registered as a Nevada company. DNA, like  Universal Express Inc., also conducted business from Boca Raton. (See the Better Business Bureau listing for DNA, which purported to be in the business of helping the AMBER Alert program rescue abducted children — while also purporting to be in the cell-phone, mortgage-reduction and “resorts” businesses. Although DNA appears to be defunct, it maintains a website — one that once redirected to the OWOW website. While actively conducting its purported business, DNA made bizarre claims about “going public.” Such claims have been associated with penny-stock scams and securities fraud.)

    Joe Reid, a Piccolo business associate who helped DNA flog its mind-numbing mess to the international masses, was one of the speakers on a Nov. 11 TCN conference call. TCN is proceeding out of the gate in largely the same fashion DNA came out of the gate: conference calls featuring Reid, claims of rapid expansion involving tens of thousands of new recruits in days, a launch-countdown timer (now removed), suggestions of incredible earnings potential 10 levels deep, Blog and website posts, YouTube videos.

    Here, now, a list of  additional red flags and some additional background . . .

    RED FLAG: Piccolo has a history of threatening to sue critics and of planting the seed that, if lawsuits do not work, he knows people who can cause critics to experience physical pain. He is known to operate in the area of Boca Raton, although Piccolo also has been known to operate in California.

    RED FLAG: DNA promos in 2010 referenced a purported texting and data expert by the name of Anthony Sasso. Sasso, a convicted felon arrested in a 2005 racketeering case in Broward County, Fla.,  was described in DNA promos as “The King Of Data For Dollars” and was said to be the “owner of the largest database of text numbers in the world.” Although Sasso appears not to have been referenced in the context of TCN, both DNA and TCN purport to be in businesses that involve texting.

    RED FLAG: Early affiliates of TCN have identified Brett Hudson as the president of Text Cash Network Inc. Records in Wyoming show a company by that name was registered in the state on Nov. 8, 2011 — just days ago. Affiliates also have vaguely described Text Cash Network Inc. as “a new division of a five year old communications company owned 100% by The Johnson Group.” No state of registration was listed in promos that referenced The Johnson Group, and the “communications company” and the “division” under which Text Cash Network Inc. purportedly operates are far from clear.

    Wyoming records show a company by the name of The Johnson Group Inc., but it is unclear if it is the same company referenced by TCN affiliates. The Wyoming records of The Johnson Group entity contain this notation: “Standing – Tax: Delinquent.” The firm appears to have used a residential dwelling in New Jersey as the address of its corporate headquarters.

    RED FLAG: TCN’s website design and “prelaunch” approach are similar in a number of key ways to the tactics employed by DNA, which planted the seed last year that it could help the AMBER Alert program rescue abducted children by paying DNA members to record the license-plate numbers of automobiles for entry in a purported database. (Some of these commonalities are referenced lower in this story.)

    Until four days ago, a promo for TCN appeared on the website of OWOW, a site linked to Piccolo. (Referenced in Editor’s Note above.) The TCN promo then vanished mysteriously, possibly because Ponzi forum posters were questioning whether Piccolo was involved with TCN. The OWOW website previously was linked to the DNA scam, and also was linked to purported cancer cures.

    DNA — as is a Piccolo signature — sold the purported tax benefits of joining the DNA “program,” which traded on the names of Oprah Winfrey and Donald Trump and also purported to offer a “free” cell phone with “unlimited” talk and text for $10 a month. The purported cell-phone “program” used the intellectual property of Apple Inc., claiming that DNA had a “branding” relationship with the company led by the late Steve Jobs. No DNA cell phone appears to have emerged in the marketplace. No branding deal with Apple appears to have existed.

    RED FLAG: On its pitch page, TCN currently is publishing the logos of Groupon, Google Offers and Bing Shopping, among others. Last year — in addition to using the intellectual property of Apple and the images of Winfrey and Trump — DNA  used email pitches to compare itself to “FACEBOOK, GOOGLE & WALMART…” It is common for hucksters to tie an upstart business to an established business as a means of creating the appearance of legitimacy. Brand leeching is common in the worlds of MLM scams and securities swindles.

    RED FLAG: Joe Reid, the Piccolo business associate, has led the conference-call hype for TCN and has suggested TCN is the next Groupon, which recently conducted an IPO.  Reid also led the conference-call cheerleading last year for DNA, which purported to be “going public”  while making a bizarre reference to Martha Stewart. DNA appears never to have gone “public.” Some members said the firm never paid them, but continued to charge them — and at least one website is claiming that Piccolo (aka “Mr. P.”)  stiffed it on orders for bottled water in the OWOW program.

    Things got so strange at DNA that the firm asked members to imagine that an earlier “launch” (March 2010) had not occurred and to reimagine a relaunch that occurred last summer (July 2010) as the only time the company had launched.

    DNA members were told it was the “MORAL OBLIGATION” of churches to pitch the firm’s purported “program.” Some DNA promos accented DNA commissions purportedly paid 10 levels deep. TCN also is accenting a 10-level payment plan.

    RED FLAG: In November 2010, the PP Blog published a story about the FBI foiling a Thanksgiving holiday bombing plot at a Christmas tree lighting ceremony in Portland, Ore. The Blog’s report was wholly unrelated to DNA or OWOW.

    An OWOW/DNA/Piccolo apologist who identified himself to the PP Blog as “John” took great exception to the Blog’s report on the Portland plot, despite the fact the Blog’s report did not reference OWOW, DNA or Piccolo in any way.

    RED FLAG: Like DNA, TCN also is being promoted on Ponzi scheme forums such as MoneyMakerGroup.

    When things went south at DNA last year, the DNA site began to redirect to the OWOW site, which was hawking products linked to Piccolo, including a purported “magnetic” product that prevented leg amputations while also helping garden vegetables grow to twice their normal size.. The DNA site then mysteriously stopped redirecting to the OWOW site — on a date uncertain, but after Piccolo started promoting OWOW products as cancer cures or treatments. At least one OWOW affiliate was trading on the name of the National Institutes of Health.

    RED FLAG: Both the TCN site and the DNA site are using Alexa charts that provide viewers the same sort of fundamentally meaningless comparisons — while the sites accent the word “free.”

    RED FLAG: Like the DNA site, there is no obvious way on the TCN site for prospects to contact Support.

    RED FLAG: Like the DNA site, the TCN site is using Google Translate. The use of the Google service — along with other commonalities on both sites — leads to questions about whether TCN and DNA are using the same designer.

  • UPDATE: ‘JustBeenPaid’ Promos Trading On Name, Likeness Of Oprah Winfrey; ‘Click On The Oprah Banner Below,’ Ad Instructs

    Screen shot: Pitchmen now are trading on the name of Oprah Winfrey to hawk JustBeenPaid. The name and likeness of Warren Buffett also have been used in JustBeenPaid pitches, and Ponzi forum chatter also includes the name of Charlie Sheen.

    UPDATE: In addition to trading on the name of Warren Buffett, the JustBeenPaid “program” is trading on the name of entertainment icon and business titan Oprah Winfrey.

    Actor Charlie Sheen’s name also has been referenced in Ponzi forum chatter about JustBeenPaid, an “opportunity” whose braintrust once recruited members for Florida-based AdSurfDaily. ASD, according to the U.S. Secret Service, was operating a $110 million Ponzi scheme.

    YouTube recently has been deleting JustBeenPaid promos.

    JustBeenPaid became a darling of the Ponzi scheme boards earlier this year. The Winfrey development occurs against the backdrop on a September incident in which Club Asteria — another Ponzi board darling — published a likeness of actor Will Smith in a promo.

    Club Asteria later removed the image, which featured Smith’s likeness over a “JOIN NOW” button. It is common for schemes to plant the seed that a famous person or entity endorses a “program” — even when no such endorsement exists.

    Winfrey’s name and likeness repeatedly have been used by scammers to sanitize their fraud schemes, leading to litigation filed by Winfrey herself, the Federal Trade Commission and the attorney general of Illinois.

    “Click on the Oprah banner below,” a prompt for a current JustBeenPaid promo urges. A likeness of Winfrey appears below the prompt, which creates the appearance that she has endorsed the “program.”

    “The Profit Program for the Most Special Moneymakers!” the promo exclaims.

    When the image is clicked, a page for a JustBeenPaid affiliate loads.
