BREAKING NEWS: Prosecutors Go Back To Court, Provide Judge Copy Of Transcript From Bowdoin’s Call Last Week

UPDATED 8:12 P.M. EDT (U.S.A.) Federal prosecutors have filed a supplemental brief in the civil forfeiture case against ASD President Andy Bowdoin that calls Bowdoin’s recent court filings “delusional.”

Meanwhile, prosecutors have provided U.S. District Judge Rosemary Collyer a copy of a transcript from a recording posted online last week by Bowdoin, calling the recording evidence that “this con man cannot manage to keep his stories straight.”

Prosecutors said Bowdoin was addressing “former” ASD members, a possible reference to the firm’s decision not to display ads, even though ASD was permitted to show ads after the seizure of Bowdoin’s assets last year.

In effect, prosecutors argued today that Bowdoin had told Collyer one story in his recent court filings and members another to explain events.

“To this Court, Bowdoin insinuates that he was misled by his former attorney before agreeing to cooperate and to release claims,” prosecutors said.  “To the former members, however, Bowdoin proclaims that ‘after a few months’ of cooperating he became ‘unhappy with [his prior attorneys’] results and decided to stop cooperating because ‘it would not have been beneficial to everyone’ for him to ‘accept a plea  deal[.]'”

“Remarkably, Bowdoin even suggests to those members participating in the conference call that the money taken from his bank accounts and, supposedly, never constituting an investment, belongs, not to Bowdoin, but to the membership. It is clear that this con man cannot manage to keep his stories straight. It is also clear that the allegation Bowdoin makes in this Renewed Motion, that he released his claims to the defendant property only after he was misled by [former counsel] Mr. [Stephen] Dobson, is delusional,” prosecutors said.

Included in the transcript were Bowdoin’s puzzling remarks about Cheryl Prewitt, the 1980 Miss America.

  1. It looks like the gov is getting tired of Bowdoin playing games and wants to bring this to a head as soon as possible. It’s about time, he’s had his chances and it’s obvious he’s learned exactly nothing over the past year. Neither have those in his inner circle and the big promoters. They’ve just moved on to other scams and/or are maintaining the illusion that ASD was legit.

    The only thing Bowdoin hasn’t done is announce a new program. Anyone giving odds?

Seems they sent him a shovel with which to dig his own hole deeper, along with LSD in order to make him delusionally think that this last conference call was a good idea. Oh, and to you fervent Andy believers out there, THIS is your genius businessman??????? wow……

    Another great article. So long as Andy is only seen as con man delusional, not medically delusional, then this is my favorite DOJ filing to date. What could possibly come out of Andy’s mouth next?

    (I’m assuming that SS Agent Roy Dotson was transcribing from an oral recording when he referred to Sarah Mattoon as being the spokesperson for the “heart and sole” of ASD. There’s a joke in there somewhere, dying to get out.)

  4. I cannot think of any good reason that they don’t just take him into custody. I wouldn’t be surprised if they arrest him any time now.

    Some of the ASD troops appeared to be getting worried over the weekend, with an email going out to gather intelligence on the
    Secret Service.

  7. Well it looks like I was right about Andy and his phone calls were going to come back to bite him in the backside. The man has an ego and it is that ego that is going to be his end.

    If it was not for that ego he would have never gone to the Florida Attorney Generals Office to complain about my postings and ASD might have still been running.

    You know, Entertained, that recording might be one of the strangest things I’ve ever heard. The prosecutors neatly turned it back on him. Basically, Andy has multiple versions — the February pro se version, the current version in the sworn affidavit, his attorney’s version — and the version Andy tells the members.

    And for Andy to say his predicament reminded him of Cheryl Prewitt’s run for Miss America . . .

    I mean, he switched immediately from this — “And I’ve spent over a million dollars on legal fees to get your money back and to stay out of prison” — to this — “And it reminds me of this person back in Mississippi: Cheryl Blackwood. She was Miss America 1980.”

    Fava came out with an email last week when he heard the Secret Service was making calls. Of course, he also passed along a one-sided analysis of the remarkable strength of ASD’s case at the evidentiary hearing last fall, which was coupled with the bizarre line that the judge was brainless and on-the-take if she didn’t see the beauty of the ASD business model.

    And this occurred while the ASD side was waiting for a ruling. Here is a trip down Memory Lane to Oct. 2008, the analysis Fava passed along from “Ken.”

    “This is only my 2 cents worth, I too read both summaries, and I CAN read legalese, the government had absolutely nothing and so the AG had to rehash the same old nonsense, all he did was just change the order of things around a bit hoping to fool the judge into believing he had something. Everything really hinges on the fact that it was not a Ponzi and the AG has already admitted to the fact that it WAS NOT A PONZI. So if you don’t have anything then the old saying really applies in this case, “baffle them with bull****”, and that is all the AG had, he just wrote and wrote and wrote and didn’t say anything because his original premise was gone. I don’t think his bull**** is going to baffle this judge. His brief did nothing more than to show just how desperate he is to try to win anything and just how poorly he has performed in presenting his case. When we win this one he will be open for damages. We will prove the hardship and damage his illegal actions did to literally thousands of families across the country.

    “The ASD brief was absolutely brilliantly written and so well done so that with a few names omitted most of it would be a perfect training manual for ASD so as to explain how the program works. Unless the judge is brain dead or taking a payoff which neither would be true in her case, we are going to win this one. Sleep well, this one is going our way. Believe me I have been around the legal system a bit, and I am not telling myself what I want to hear. Our legal team earned their money and they have a lot of work to do. I DO NOT like attorneys but in this case I will make an exception. They ARE good, they need to be paid NOW, and they have a lot of work to do.”

    And, speaking of things that happened while waiting for rulings, ASD’s Praebius venture story about the purported $200 million revenue infusion also came out while the judge was considering the issues.

    The faithful raced to forums to share the good news about Praebius, and then the story disappeared from ASD’s website.

    All of ASD is an exercise in “I had my fingers crossed” and Andy can change whatever he wants whenever he wants. Unfortunately for Andy, his TOS does not apply to everyone on earth just because we inhabit the same planet as him.

    His habit of changing everything to suit himself will not play well with the judge.

    I noticed that from listening to the call as well. It sounded to me that Andy was reading from a script, probably prepared by one or more long time ponzi players/promoters.

    What in the world does Andy expect to accomplish by playing all these games? Surely he can not be so stupid as to believe that getting the membership behind him will resolve all his issues. This is not a voting contest and he is not running for Prom Queen this is a Federal Forfeiture Case against HIS money and HIS property.

  12. The curtain has now fallen on Scene I of ACT IV. Scene II is going to be a humdinger setting the stage for Scene III which will have even more fireworks. Now it is time for you to get settled in your comfy chair, a full bowl, or tub, of popcorn, and your big drink because there won’t be an intermission between Act II and Act III; but just a quick respite.

    Now it is really going to get good, and it will have a full cast on stage. It will be all hands on deck affair, and you may need a scorecard to keep track of them all. I just finihsed popping my tub of popcorn, extra big drink is in hand (64oz), and my cushy recliner to enjoy the show. Get your goodies now as this is Last Call before all the fun and games begin.

    You might be right about this; I thought I heard the briefest of pauses before Andy spoke the name of Cheryl Blackwood, for example. It struck me as though he could not instantly recall the name and had to take a quick glance at something.

    The delivery in that section of the recording required recall and a command of facts, and Bowdoin’s delivery did not persuade me he was speaking extemporaneously. I was left wondering whether he was a Cheryl Blackwood fan or if he was relating the words of somebody who was — and perhaps thought it added a nice touch.

    He clearly has a need to tell people the government seized THEIR money, which is contrary to his own theory of the case — one of them, at least.

    According to Fava, ASD’s case at the evidentiary hearing was brilliant, right? So why did Andy fire the Ackerman Senterfit law firm, calling them incompetent? Never mind — by now it’s screechingly obvious that every word they say or write is totally insane.

Sara, I hope you enjoy prison, and you can get someone to take care of your husband. Why, oh why, do you continue to do such stupid, and criminal, things?
