Guenther Softens Comment That ‘Sheriff Joe’ Arpaio Was Soft On Crime; Says Recent Email Lecturing Veteran Federal Prosecutor Was Sent At Behest Of Crime Victims
AdSurfDaily mainstay Bob Guenther backed away overnight from a comment that suggested an Arizona county sheriff known for instituting chain gangs and outfitting prisoners in pink underwear was soft on crime.
Sheriff Joe Arpaio of Maricopa County would be Guenther’s jailer if he is convicted and sentenced to prison in the county. Guenther, 61, is accused of two felonies in Maricopa County by the Mesa Police Department, which said he repeatedly violated a court order not to harass a gaming company with which he has a dispute.
Guenther complained early Wednesday that an individual he described as a criminal “is still walking the streets, still taking in millions of investors money, still hiding assets, right there under Sheriff Joe’s nose..â€
Overnight, however, Guenther softened his remarks about Arpaio.
“I made no disparaging comments regarding Sheriff Joe,” Guenther said. “Mesa, AZ is just in his jurisdiction.”
Guenther, who pleaded guilty to felony bank fraud in 1994, did not back away from claims that he would use unspecified “political connections” to embarrass the U.S. Department of Justice, which he suggests has ignored leads he provided and conducted an incompetent investigation in the AdSurfDaily wire-fraud, money-laundering and Ponzi scheme case.
He complained that Senior Trial Attorney William Cowden had not returned more that 50 emails he had sent. Federal prosecutors, however, are under no obligation to return emails, and the ASD case is an investigation in progress.
On Monday, for example, the U.S. Secret Service filed a new document in the case — the transcript of an audio recording ASD President Andy Bowdoin made earlier this month. Bowdoin has suggested in court filings that he was indicted under seal in May. Prosecutors revealed in April that Bowdoin had signed a proffer letter in the case.
Guenther’s most recent email to Cowden had a condescending tone, including a passage that began, “How about this one Bill, just as a freebie.”
The email lectured the prosecutor, an expert in forfeiture law and part of the prosecution team that gained a conviction against the e-Gold payment processor last year for facilitating money-laundering.
ASD once used e-Gold as its payment processor.
“I will not sit on this anymore, you are going in circles . . . ” Guenther said in his email to Cowden. “You have my number and my email..”
In April, on this Blog, Guenther reproduced an email he had received from Cowden in February. In his one-sentence response to Guenther, the prosecutor noted that he earlier had explained that the case was the Justice Department’s to handle and that it would proceed as it saw fit.
“As I have said before, we intend to use forfeited assets (upon liquidation) to compensate Ponzi victims,” Cowden said.
Guenther reproduced the same information on the ASDMBA website, but continues to suggest Cowden has a duty to reply to all of his emails and perhaps even reveal the government’s prosecution strategy.
Guenther is the de facto head of the ASD Members Business Association (ASDMBA), which has come under fire for collecting money from ASD members to establish legal representation but not providing straightforward accounting on how the money was spent.
At the same time, Guenther also has asserted that, through his efforts, money that had been directed at Golden Panda by active-duty police officers and retirees from Texas and California was intercepted and returned to the police groups before it could become part of a victims’ compensation pool prosecutors said they sought to establish.
Cowden referenced the pool in his February response to Guenther’s email.
Meanwhile, Guenther also says that money others directed at Golden Panda — including money from a “high profile Dallas Cowboy executive” — was intercepted and returned to contributors before it could become part of a victims’ pool.
Overnight, Guenther explained that his most recent email to Cowden was sent at the behest of “concerned” crime victims.
“My letter to William Cowden was requested by several concerned groups of victims,” Guenther said. “Over 300 ASD and Panda victims, most of whom have given Andy [Bowdoin]/ASD or [Golden] Panda over $5000. Another particular group of over 400 people, represented by four Atlanta area men gave [Golden Panda Ad Builder President Clarence] Busby over $1.8Million, none of which was earned through ASD, so there is no link between the two.”
Prosecutors, however, filed an “all funds” forfeiture complaint last August that targeted assets of both ASD and Golden Panda in the same proceeding. The government has established ties between the firms, and one of the pro se filers in the case — Joyce Haws — has been identified as a rally coordinator for ASD and a founder of Golden Panda.
Busby identified Haws as one of 34 Golden Panda founders in court filings.
Meanwhile, Guenther implied in his email that ASDMBA soon would become active again, in part because the government was botching the case. He predicted that the Rev. Al Sharpton and the Rev. Jesse Jackson would become advocates for victims who attended “a very high-profile African-American church in Atlanta.”
“When this comes out, and it will, this very, very high profile church will call on the likes of Jesse Jackson and Al Sharpton to assist in getting their money back,” Guenther said. “They have asked me to help.”
Rather than be passive, ASDMBA would be aggressive, Guenther said.
“So now it is time to round up all the troops again and get ready to try and “GO GET THE MONEYâ€..
I suspect that part of the “liquidated assets” will include those of one loudmouth with a habit of injecting himself into federal investigations, if his previous creditors don’t get to him first.

Wouldn’t this just add another circle to the ASD circus! In my opinion, although Jackson and Sharpton have probably meant well in the past by getting involved with different issues, they have often stuck their noses into places where they don’t belong …. and often mess up things more in the process. IF the “very, very, high profile church” calls on them, HOPEFULLY Jackson and Sharpton will contact Cowden BEFORE they act and speak!

Here we go again with the big church in Atlanta. In a phone conversation (which I now regret having had) with Bob he ranted on about this big Afro American church in Atlanta that had 1500 members who had put money into ASD and how they were going to send the Black Panthers after Andy. Of course if we are to believe Bob then Andy should be in his grave and not be filing frivolous papers with the court.

My EX-boyfriend, who talked me into investing $46,000 in Golden Panda (in his name), told me that we aren’t getting any money back at all because it was all forfeited to the government. He filled out the paperwork as a victim, but SAYS he got an email from ASD about not getting the money back. Is that correct? He’s a pathological liar and I don’t know whether to believe him or not. Thank you.
Stacey, my understanding is that for the G.P. part of the money, the forfeiture was not contested. I suspect that the judge may need to rule on if the surrender by Busby is acceptable before the forfeiture is complete.
The government has expressed the intention to return funds to the victims. I suspect that it will take a long, long time for this to happen. It may be quicker for the G.P. money because of Busby’s surrender.
If the money is in your ex’s name, I suspect that the money would be returned to him. You might need to trust him to return it to you. As it’s a reasonable sum you may like to take legal advice. Maybe you can sue him for the sum “invested”.

Your sad case raises a couple of potentially complex issues. First, unless you were the member who made the investment in your name, you might not qualify as a victim under the government’s proposed restitution program.
Your claim might be against your ex-boyfriend, perhaps both civilly and criminally. If he duped you into this scheme and got you to turn over your money to him, it could be viewed as a criminal deception. It might be best for you to contact an attorney and ask for guidance on how you should proceed.
There perhaps is a civil remedy — basically suing your ex for the loss.
You mentioned that your ex told you that you weren’t getting any money back because it was forfeited to the government. If I were you, I’d be concerned about that because it could be his way of avoiding any culpability. He simply blames it on the government and washes his hands of the matter.
The government, however, has said it intends to implement a restitution program for crime victims. No one will get back 100 cents on the dollar when such a program begins.
But if your ex was the registered member and the investment of your money was in his name — and if he filled out the victim’s form — he would be counted among the people who filled out the form and made the overture for restitution.
He theoretically could get a partial refund — and you’d never know. That’s why I think you need to speak with an attorney.
Another potential problem is that the government might view him as a perpetrator, not a victim, perhaps particularly if he introduced others to the scheme in sufficient numbers and dollar volume. Only the prosecutors know what that threshold is.
You also noted he SAYS he got an email from ASD about not getting the money back. That’s troublesome because it could be yet another way he is trying to insulate himself from civil/criminal exposure. If blaming it on the government doesn’t work for him, he might be setting the stage to blame ASD.

Sounds like your ex would fit in well with the pathological liars at the core of ASD. If such a letter exists from ASD, rest assured that it is a lie. All relevant authorities have indicated that they will be sending out some amount of restitution, with a formula yet to be determined. Historically people have recovered 20% to 30%, but it does take a while.
My bet is that your ex is lying again to try to collect all of the restitution himself. He claims that ASD sent him a letter, but as outlined by various posters, the contents of that letter are a lie (if the letter exists, and even if it does, why, oh why, would ASD send him a letter regarding a Golden Panda issue? Sue him, and never believe in things that are too good to be true, just like your momma taught you…….

Everyone has an opinion. I am leaving for DC in the morning, perhaps I can shed some light on this when I return, I doubt it though, but this much I DO KNOW.
Busby relinquished claim to the Panda funds and cut a deal with the Feds. The money was offically ordered forfeited by Judge Collyer. Because Panda was purportedly funded by ASD funds and much of the forfeited Panda funds consists of money invested by ASD winners, NO ONE will get a dime back for some time, and in my opinion, it will be YEARS before a Trustee could even try to return any money, if the Government choses to do so.. The Government is under NO LEGAL obligation to return ONE DIME to the losers in ASD or Panda.
When my lawyer and I met with Bill Cowden at the DOJ office last November, he personally assured us that the ASD victims would receive restitution if the Government prevailed. He subsequently affirmed that in a email several months ago. HOWEVER, certain things have transpired within the DOJ that gives me great concern that is not true, and now of course,Cowden is GONE.
Absolutely nothing will happen to the Panda monies until Judge Collyer rules on the ASD matter. With the recent resignation of the Chief Prosecutor, William Cowden, the new prosecutor assigned to the case will undoubtedly need time to get up to speed on the case. There is hard evidence there was comingling of ASD and Panda funds, so rest assured, no Panda money is going anywhere.
What you ex did or did not hear from ASD is irrelevant.Nothing factual has come from ASD since the inception of the company. Concult your divorce attorney regarding your property settlement, at the very least, consult your CPA and see what the disposition is regarding a potential tax wrote off. IN SHORT, dont take advice from me, or anyone else. Ask your lawyer and/or your CPA, but dont look for any of your money, or your husbands money for years.
